You agree to use this site only for lawful purposes and not to misuse, copy, or redistribute its content without permission.
No Warranty on Site Content
Information on this site, including pricing indications, lead times, product specifications, and stated statistics, is provided as general guidance and is subject to change. It does not constitute a binding quote or contract. A formal, project-specific proposal is required before any work begins.

All content on this site, including text, graphics, logos, and images, is the property of American Material Handling Co. Inc. or its licensors and is protected by applicable intellectual property laws.
Limitation of Liability
To the fullest extent permitted by law, AMH shall not be liable for any indirect, incidental, or consequential damages arising from your use of this site or reliance on its content. Nothing in these terms limits liability that cannot be excluded under applicable law.
Changes to These Terms
We may update these Terms of Service from time to time. Continued use of the site after changes are posted constitutes acceptance of the revised terms.
Terms & Conditions of Sale
These Terms & Conditions apply to any material supplied and/or work performed by American Material Handling Co. Inc. (“AMH”). They are incorporated into the documents provided to you (“Customer”). Acceptance of the Quote by the Customer constitutes acceptance of these terms.
- Quote: The quote has been prepared based on the information provided and is valid for five (5) days from the date supplied by AMH. If the Customer does not accept the quote within five (5) days, AMH reserves the right to withdraw it.
- Changes: Any changes required, including but not limited to configuration changes by the Customer or as mandated by regulatory authorities after the Quote date, will be discussed with the Customer when known. A new quote or updated sales order will be provided to reflect these changes. AMH reserves the right to substitute quoted used materials with similar items from our inventory to best suit the job at no additional cost to the Customer.
- Installation: The Customer agrees to ensure the installation site is free and clear by the agreed installation date and will provide AMH with 110V AC access. Any delays, additional starts and stops, wait times, or requirements for unquoted equipment (e.g., power generator) may result in additional charges.
- Freight: Freight is an estimated cost and is subject to change based on current rates and the number of trucks required at the time of shipment. Terms are FOB Destination.
- Title: Title and risk of loss pass to the Customer upon delivery to the Customer's facility or acceptance of material at AMH's shipping location by an employee or agent of the Customer. AMH retains a security interest in and the right to repossess any material until paid in full.
- Restock/cancellation fee: AMH reserves the right to charge a 25% restocking and cancellation fee on all used materials. Non-standard custom and new materials cannot be returned or cancelled.
- Warranty: AMH will assign any applicable manufacturers' warranties to the Customer to the extent they are assignable. AMH agrees to perform any installation work in a professional and workmanlike manner in accordance with the written plans and specifications.
- Invoice: AMH will provide progress invoices as outlined in the terms of the Quote and an itemized final invoice upon completion of work, detailing any applicable taxes, changes, and/or additional charges described above. Taxes are estimated at the time of the quote. Any applicable taxes, tariffs, surcharges, or additional fees imposed by a third party entity which are required to be collected or paid shall be the responsibility of the Customer.
- Payment: A three (3%) fee will be added for any orders over $2,500.00 paid by credit card.
- Limitation of Liability: To the maximum extent permitted by law, AMH's liability for any claim arising out of this agreement, including but not limited to any claim for breach of warranty, negligence, strict liability, or otherwise, shall not exceed the total amount paid by the Customer for the specific goods or services giving rise to the claim.
- Force Majeure: AMH shall not be liable for any delay or failure in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, labor disputes, natural disasters, pandemics, or interruptions in supply chains. In such events, AMH shall be entitled to a reasonable extension of time for performance.
- Applicable Law: The Parties agree that if there is a breach of this contract and/or any dispute as to payment, any action will commence in a Tennessee state or federal court and Tennessee law will apply. AMH reserves the right in any action to seek compensatory damages, interest, attorneys' fees, or any other remedy at law or in equity if a dispute in payment results in litigation.
